Attorneys for Gov. Bill Walker are fighting an attempt to prolong litigation challenging Walker’s authority to expand Medicaid unilaterally.
Department of Law attorneys say there’s no evidence that a request to substitute the Alaska House as the plaintiff in the case was authorized by the House or the Legislative Council. They say the request should be denied.
The council initiated the lawsuit last summer. It was dismissed by a state court judge in March.
Earlier this month, attorneys for the council filed a notice of appeal on behalf of the House. They sought an order substituting the House for the council in the litigation.
In a filing, they say the council authorized the lawsuit recognizing it could involve proceedings before the Alaska Supreme Court. They say the Senate informally indicated it didn’t want to proceed.
